§ 2 Data protection
As a user of our website and, if applicable, a client, you will receive all the necessary information in this privacy policy about how, to what extent and for what purpose we or third-party providers collect data from you and use it. The collection and use of your data is carried out strictly in accordance with the requirements of the Federal Data Protection Act (BDSG), the Telemedia Act (TMG) and the EU GDPR.
We feel particularly committed to the confidentiality of your personal data and therefore work strictly within the limits set by the legal requirements. The collection of this personal data is voluntary if we can do so. We also only pass this data on to third parties with your express consent.
We ensure a high level of security for particularly confidential data, such as in payment transactions (bank details, etc.) or with regard to your inquiries to us (forms), by using SSL encryption. However, we would like to take this opportunity to point out the general dangers of using the Internet, over which we have no influence. In email traffic in particular, your data is not secure without further precautions and may be collected by third parties.
§ 3 What is personal data, how is it collected and used?
Personal data is information about the factual or personal circumstances of a specific or identifiable natural person. If we collect personal data – such as your name, address or email address – this data collection is voluntary. Without your express consent, this data will not be disclosed to third parties. In the context of data avoidance and data economy, we only collect personal data to the extent and for as long as it is necessary to use our website or is required by law. Statistical data that we collect, for example, when you visit our websites and that cannot be directly linked to you are not included here. For example, these are statistics about which pages of our website are particularly popular or how many users visit certain pages of the website.
We take the protection of your personal data seriously and strictly adhere to the relevant legal regulations and this data protection declaration when collecting and processing personal data. If the purpose of the data collection no longer applies or the end of the statutory storage period has been reached, the data collected will be blocked or deleted. Our website can usually be used without disclosing personal data. Please note that data is not always transmitted securely on the Internet. Protection during data exchange cannot be guaranteed, particularly in email traffic.
When you visit our websites, our web servers temporarily record the domain name or IP address of your computer, the client’s file request (file name and URL), the HTTP response code and the website from which you are visiting us. The logged data is used exclusively for data security purposes, in particular to ward off attempted attacks on our web server, and for statistical evaluations. It is neither used to create individual user profiles nor passed on to third parties and is automatically deleted after 7 days at the latest.
We collect, store and process your data for the entire process during the contract processing or your purchase, including any subsequent warranties, for our services, technical administration and our own marketing purposes. Your personal data will only be passed on or otherwise transmitted to third parties if this is necessary for the purpose of contract processing or billing or if you have previously consented. As part of the order processing, for example, the service providers we use here (such as transporters, logistics companies, banks) receive the necessary data for order and order processing. The data passed on in this way may only be used by our service providers to fulfill their tasks. Any other use of the information is not permitted and will not be carried out by any of the service providers entrusted with us. We need your correct name, address and payment details for your offers/orders/invoices.
We need your email address so that we can confirm receipt of the order/order-related information etc./exchange and communicate with you. You will also receive order and shipping confirmations via your email address, but never advertising emails unless you have expressly consented to these. Your personal data will be deleted unless statutory retention periods prevent this and if you have asserted a right to deletion, if the data is no longer required to fulfill the purpose for which it was stored, or if its storage is not permitted for other legal reasons.

Your personal data, as well as your company data and all information that you provide to us voluntarily and using SSL encryption in our interpretation form, are required to create an offer or to conclude a contract with us. You are not obliged to provide your personal data. However, without your address we cannot send you the information, offers, products, etc. you require. The data you enter in the interpretation form is therefore processed for the purpose of fulfilling the contract.
If you send us an inquiry by email, via a contact form, etc. before concluding the contract, we will process the data received in this way to carry out pre-contractual measures and, for example, answer your questions about our products.
(2) Legal basis
The legal basis for this processing is Art. 6 Para. 1 b) GDPR.
(3) Recipient categories

(4) Storage period
We store the data required to process the contract until the expiry of the statutory warranty and, if applicable, contractual guarantee periods.
We store the data required under commercial and tax law for the periods specified by law, usually ten years (see Section 257 of the German Commercial Code (HGB), Section 147 of the German Fiscal Code (AO).
The data processed to carry out pre-contractual measures are deleted as soon as the measures have been carried out and it is evident that no contract will be concluded, but no earlier than after 24 months.
§ 5 Where is my data processed?
If Winkelnkemper GmbH collects, processes and/or uses data, this will only take place within the territory of the Federal Republic of Germany, in a member state of the European Union or in another state party to the Agreement on the European Economic Area. Any transfer to another third country requires the prior consent of the client and may only take place if the special requirements of Art. 44 GDPR are met.
§ 6 How safe is my data?
To protect your data from unauthorized access and misuse, we have taken extensive technical and operational security precautions in accordance with German law.
Technical and organizational measures for data security
We design the internal organization in our area of responsibility in such a way that it meets the requirements of data protection. In doing so, we take technical and organizational measures to adequately protect the data against misuse and loss in order to meet the requirements of the GDPR.
The parties agree that the technical and organizational measures are subject to technical progress and further development. In this respect, Winkelnkemper GmbH is permitted to implement alternative, adequate measures. It must inform the client of this upon request and ensure that the security level of the specified measure is not undercut. The contractor must ensure security in accordance with Art. 28 Para. 3 lit. c, 32 GDPR, in particular in conjunction with Art. 5 Para. 1, Para. 2 GDPR. Overall, the measures to be taken are data security measures and to ensure a level of protection appropriate to the risk with regard to the confidentiality, integrity, availability and resilience of the systems. Significant changes must be documented.
§ 7 Can I use contact forms or the interpretation form without any concerns?
If you send us inquiries using the contact form or interpretation form, your details from the form, including the contact details you provided there, will be stored by us for the purpose of processing the inquiry and in the event of follow-up questions. We will not pass on this data without your consent and will only use and store it in accordance with the statutory provisions. If we have no follow-up contact within 24 months, your data will be deleted. Furthermore, you will not receive any advertising emails or a newsletter from us unless you have explicitly requested this and have agreed to it.
§ 8 Will my data be passed on to third parties?
Your personal data will only be passed on or otherwise transmitted to third parties if this is necessary for the purpose of contract processing or billing or if you have previously consented.
In certain cases, we are legally obliged to transmit data to a requesting government agency. In addition, we do not pass on data to third parties unless you have expressly consented. In individual cases, the controller can arrange for the data to be passed on to one or more processors, for example a parcel service provider or freight forwarder, who also uses the personal data exclusively for internal use that is attributable to the controller. For this purpose, only personal data that is necessary for the provision of the service is transmitted. (E.g. recipient data)
§ 9 How long will my personal data be stored?
The criterion for the duration of storage of personal data is the respective statutory retention period. After expiry of the period, the corresponding data is routinely deleted unless it is no longer required to fulfill or initiate a contract.
§ 10 Existence of automated decision-making (profiling)
As a responsible company, we do not use automated decision-making or profiling.
§ 11 How do I get information about my stored data?
You can request information about the scope, origin and recipients of the stored data as well as the purpose of storage at any time and free of charge. You can find further information on this under the heading: “Your right to information, deletion and blocking”.
§ 12 Can I have data corrected?
You can request that incorrect data be corrected at any time.
§ 13 Who should I contact if I have questions about data protection or my data at Winkelnkemper GmbH?

§ 14 What will my data be used for?
The personal data you enter/provide will be collected and stored exclusively for internal use by the controller and for its own purposes. The controller can arrange for the data to be passed on to one or more processors, for example a parcel service provider, who will also use the personal data exclusively for internal use attributable to the controller.
Legal or contractual provisions for the provision of personal data; necessity for the conclusion of the contract; obligation of the data subject to provide the personal data; possible consequences of non-provision.
We would like to inform you that the provision of personal data is partly required by law (e.g. tax regulations) or can also result from contractual provisions (e.g. information on the contractual partner). In order to conclude a contract, it may sometimes be necessary for a data subject to provide us with personal data, which must then be processed by us. For example, the data subject is obliged to provide us with personal data if our company concludes a contract with them. Failure to provide the personal data would mean that the contract with the data subject could not be concluded. Before the data subject provides personal data, the data subject must contact one of our employees. Our employee will clarify to the data subject on a case-by-case basis whether the provision of the personal data is required by law or contract or is necessary for the conclusion of the contract, whether there is an obligation to provide the personal data and what consequences the non-provision of the personal data would have.
§ 15 Your right to information, deletion and blocking
You can obtain information about the personal data we have stored about you, as well as the origin, recipient and purpose of data collection and processing, free of charge at any time. You also have the right to request the correction, blocking or deletion of your data. This does not apply to data that is stored due to legal regulations or is required for proper business processing. To ensure that data can be blocked at any time, data is kept in a blocked file for control purposes. If data is not covered by a legal archiving obligation, we will delete your data at your request. If the archiving obligation applies, we will block your data.
You can review or delete the data we have stored about you at any time, or revoke your consent to its use.
You can use the following “Data deletion” form to do this.
Download PDF file for data inspection/deletion
For all questions and concerns regarding the correction, blocking or deletion of personal data, please contact our data protection officer using the contact details in this data protection declaration or at the address provided in the imprint.
§ 16 Secure data transfer
We transmit your personal data securely using encryption. This applies, for example, when transferring/filling out forms.
This encryption is activated, for example, when you send us enquiries via our website. We use the SSL (Secure Socket Layer) coding system.
We also use technical and organizational measures to protect our websites and other systems against loss, destruction, access, modification or distribution of your data by unauthorized persons.
Please ensure that SSL encryption is activated on your side when you carry out corresponding activities. The use of encryption is easy to recognize: the display in your browser line changes from “http://” to “https://”, symbolized by a lock in front of the domain. Data encrypted using SSL cannot be read by third parties. Only transmit your confidential information when SSL encryption is activated and contact us if in doubt.
§ 17 Will my data be used for advertising purposes?
In addition to processing your data to provide our services or sell our products, we also use your data to communicate with you about your orders, certain products or marketing campaigns and to recommend products or services that may be of interest to you.
You can object to the use of your personal data for advertising purposes at any time, either in whole or in part, without incurring any costs other than the transmission costs according to the basic rates. A message in text form to the contact details specified under point 1 (e.g. email, fax, letter) is sufficient for this.
§ 18 Newsletter
Winkelnkemper GmbH does not currently use newsletters or newsletter systems.
§ 19 Data protection in applications and in the application process
Winkelnkemper GmbH collects and processes the personal data of applicants for the purpose of processing the application process. Processing can also be carried out electronically. This is particularly the case if an applicant sends corresponding application documents to Winkelnkemper GmbH electronically, for example by email or via a web form on the website. If we, Winkelnkemper GmbH, conclude an employment contract with an applicant, the transmitted data is stored for the purpose of processing the employment relationship in compliance with the statutory provisions. If Winkelnkemper GmbH does not conclude an employment contract with the applicant, the application documents are automatically deleted two months after notification of the rejection decision, provided that there are no other legitimate interests of the person responsible for processing that conflict with deletion. Other legitimate interests in this sense include, for example, the burden of proof in proceedings under the General Equal Treatment Act (AGG).

§ 20.1 Cookies
We use cookies on our website. These small text files are stored on your PC by our server. They support the display of our website and help you to move around our website. Cookies collect data about your IP address, your browser, your operating system and your internet connection. We do not link this information to personal data and do not pass it on to third parties. Under no circumstances will we use cookies to bring malware or spy programs onto your computer. You can also use our website without using cookies, which may mean that some of the displays and functions of our offer may only work to a limited extent.
Accepting cookies is not a requirement for visiting our websites. However, we would like to point out that our website and service only have limited functionality if you do not allow us to set cookies.
What are cookies?
Cookies are small files that are stored on your data storage device and that store certain settings and data for exchange with our system via your browser. Basically, there are two different types of cookies, so-called session cookies, which are deleted as soon as you close your browser, and temporary/permanent cookies, which are stored on your data storage device for a longer period of time or indefinitely. This storage helps us to design our websites and our offers accordingly for you and makes it easier for you to use them, for example by saving certain entries from you so that you do not have to repeat them constantly. What cookies does Winkelnkemper GmbH use? Most of the cookies we use are automatically deleted from your hard drive at the end of the browser session (end of the session) (hence session cookies).
Session cookies are required, for example, to offer you the shopping cart function across multiple pages.
We also use cookies that remain on your hard drive. When you visit again, it is automatically recognized that you have already been with us and which entries and settings you prefer. These temporary or permanent cookies (lifetime 1 month to 10 years) are stored on your hard drive and delete themselves after the specified time. These cookies in particular serve to make our offering more user-friendly, effective and secure. Thanks to these files, it is possible, for example, for you to see information on the site that is specifically tailored to your interests. The sole purpose of these cookies is to adapt our offering to your customer wishes as best as possible and to make surfing with us as comfortable as possible for you. What data is stored in the cookies? Only pseudonymous data is stored in the cookies used by Winkelnkemper GmbH. When the cookie is activated, it is assigned an identification number and your personal data is not assigned to this identification number. Your name, IP address or similar data that would enable the cookie to be assigned to you are not stored in the cookie. Based on cookie technology, we only receive pseudonymized information, for example about which pages of our website were visited, which content/products were viewed, etc.
Are there also cookies from third parties (so-called third-party cookies)?

§ 20.2 Third-party content and services
The offering on our website may also include content, services and benefits from other providers that complement our offering. Examples of such offerings are maps from Google Maps, YouTube videos or graphic representations from third parties. Accessing these third-party services regularly requires the transmission of your IP address. This enables these providers to perceive your user IP address and also store it. We make every effort to only include third-party providers who use IP addresses solely to deliver the content. However, we have no influence on which third-party provider may store the IP address. This storage can be used for statistical purposes, for example. If we become aware of storage processes by third parties, we will inform our users of this fact immediately. In this context, please also note the special data protection declarations for individual third-party providers and service providers whose services we use on our website. You can also find them in this data protection declaration – for example Google Maps.
§ 20.3 Server Logfiles
Every time you access the Winkelnkemper GmbH website, usage data is transmitted by the respective Internet browser and saved in log files, the so-called server log files. The data records saved contain the following data:
- Date and time of access
- Name of the page accessed
- IP address
- Host name of the accessing computer
- Referrer URL (origin URL from which you came to the website)
- The amount of data transferred and product and version information of the browser used.
The users’ IP addresses are deleted or anonymized after use has ended. When anonymized, the IP addresses are changed in such a way that the individual details about personal or factual circumstances can no longer be assigned to a specific or identifiable natural person or can only be assigned with a disproportionate amount of time, cost and effort. We evaluate these log file records in an anonymous form in order to further improve our service and the content of the website and make it more user-friendly, to find and correct errors more quickly and to control server capacities. For example, we can see at what times the website is most popular and provide the appropriate data volume to ensure that you can access the content/pages as quickly as possible. In addition, by analyzing the log files, we can also identify and correct any errors in the website more quickly.
§ 21.1 Confirmation by email
You consent, which can be revoked at any time, that the operator of this site may confirm your personal data, in particular address and bank details, to you without restriction by email as part of the order confirmation. You guarantee that only you or persons authorized by you have access to your email account. You are aware that only limited confidentiality is guaranteed for unencrypted emails.
§ 20.4 Use of Google Analytics
Google Analytics is a service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). Google Analytics uses “cookies”, which are text files placed on your computer, to help Google analyze how users use our website. The information collected through the cookie on your use of our website (including your IP address) is generally transferred to a Google server in the USA and stored there. Please note that Google Analytics has been extended on our websites to include the code “gat._anonymizeIp();;” to ensure anonymous collection of IP addresses (so-called IP masking). At our request, Google will therefore only record your IP address in abbreviated form, which ensures anonymization and does not allow any conclusions to be drawn about your identity. If IP anonymization is activated on our websites, your IP address will be abbreviated beforehand by Google within member states of the European Union or in other contracting states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. Google will use this information to evaluate your use of our websites, to compile reports on website activity for us, and to provide us with other services relating to website activity and the Internet. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data. Google will only transfer this data to third parties if required by law or as part of order data processing. Under no circumstances will Google combine your data with other data collected by Google. By using this website, you consent to the processing of data about you by Google, the manner of data processing described above, and the stated purpose. You can prevent cookies from being saved by setting your browser software accordingly; however, we would like to point out that in this case you may not be able to use all of the functions of our website to their full extent. You can also prevent Google from collecting the data generated by the cookie and relating to your use of the website (including your IP address) and from processing this data by Google by downloading and installing the browser plug-in available under the following link. For more information about Google Analytics and data protection, visit http://tools.google.com/dlpage/gaoptout?hl=de.
§ 20.5 Google Maps Plugin
We use a plug-in from the Internet service Google Maps on our website. Google Maps is operated by Google Inc., based in the USA, CA 94043, 1600 Amphitheatre Parkway, Mountain View. When you use Google Maps on our website, information about the use of this website and your IP address is transmitted to a Google server in the USA and stored on this server. We have no knowledge of the exact content of the data transmitted, nor of its use by Google. In this context, the company denies linking the data with information from other Google services and denies the collection of personal data. However, Google can transmit the information to third parties. If you deactivate Javascript in your browser, you prevent Google Maps from running. However, you will then also not be able to use map displays on our website. By using our website, you consent to the described collection and processing of information by Google Inc.. You can find out more about the privacy policy and terms of use for Google Maps here: https://www.google.com/intl/de_de/help/terms_maps.html.
§ 20.6 Use of YouTube
The controller has integrated YouTube components on this website. YouTube is an Internet video portal that allows video publishers to upload video clips free of charge and other users to view, rate and comment on them free of charge. YouTube allows the publication of all types of videos, which is why both complete film and television programs, but also music videos, trailers or videos made by users themselves can be accessed via the Internet portal.
The operating company of YouTube is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. YouTube, LLC is a subsidiary of Google Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA.
Each time one of the individual pages of this website, which is operated by the controller and on which a YouTube component (YouTube video) has been integrated, is accessed, the Internet browser on the information technology system of the data subject is automatically prompted by the respective YouTube component to download a display of the corresponding YouTube component from YouTube. Further information about YouTube can be found at https://www.youtube.com/yt/about/de/. As part of this technical process, YouTube and Google receive knowledge of which specific subpage of our website is visited by the data subject. If the data subject is logged in to YouTube at the same time, YouTube recognizes which specific subpage of our website the data subject is visiting when a subpage containing a YouTube video is accessed. This information is collected by YouTube and Google and assigned to the respective YouTube account of the data subject.
YouTube and Google always receive information via the YouTube component that the data subject has visited our website if the data subject is logged in to YouTube at the same time when accessing our website; this takes place regardless of whether the person concerned clicks on a YouTube video or not. If the person concerned does not want this information to be transmitted to YouTube and Google, he or she can prevent the transmission by logging out of his or her YouTube account before accessing our website.
The data protection provisions published by YouTube, which can be accessed at
https://www.google.de/intl/de/policies/privacy/
provide information about the collection, processing and use of personal data by YouTube and Google.
§ 21 Miscellaneous
§ 21.1 Confirmation by email
You consent, which can be revoked at any time, that the operator of this site may confirm your personal data, in particular address and bank details, to you without restriction by email as part of the order confirmation. You guarantee that only you or persons authorized by you have access to your email account. You are aware that only limited confidentiality is guaranteed for unencrypted emails.
§ 21.2 Objection to advertising emails
The use of contact data published as part of the imprint obligation to send unsolicited advertising and information materials is hereby prohibited. The operators of the pages expressly reserve the right to take legal action in the event of unsolicited advertising information being sent, for example through spam emails.
§ 21.3 Changes to our privacy policy
From time to time, it may be necessary for us at Winkelnkemper GmbH to change this privacy statement. We therefore recommend that you read this privacy statement regularly. However, rest assured that changes will not take effect retroactively and that we will not change the way in which previously collected data is treated.
